Please RSVP to pgarin@ithaca.edu A student accused of sexual misconduct demands to see all of the information an institution has collected related to the accusation, including investigator notes. A professor would like to add an online element to a course in which students are required to post on the discussion board and submit short assignments for peer review. A reporter has asked for a copy of a report on allegedly improper academic assistance to athletes. Not only do counsel need to understand how FERPA applies in these and other situations, but administrators, faculty, and staff on campus who have access to student information must also be able to identify potential FERPA issues in a variety of contexts. Geared towards campus counsel, administrators, and others on campus with a responsibility for FERPA compliance, this NACUA virtual seminar brings together two expert practitioners to review the most important provisions and requirements of FERPA and then explore how they apply in practice. In the first hour of the program, the panelists will focus on FERPA's key definitions and provisions, including what does and doesn't constitute an "education record" subject to FERPA, when education records may be disclosed, and when they must be made available for inspection and review and amended. In the second hour of the program, the panelists will examine how to apply FERPA to the following situations: teaching and working in the cloud, campus safety and discipline (including situations that implicate the Clery Act and Title IX), and requests for public records. Please join us for a discussion of FERPA compliance, both basic and applied, and an opportunity to ask questions of the expert panelists.
